Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the BookAPump mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. The App is operated by Concrete Pumping Services CPS, LLC ("we," "us," or "our").

2. Description of Service

BookAPump is a platform that connects contractors with concrete pumping companies. The App allows contractors to submit service requests for concrete pump trucks and allows pumping companies to manage their fleet, schedule jobs, and respond to customer requests.

BookAPump facilitates communication and scheduling between contractors and pumping companies. We are not a party to the service agreement between you and the pumping company, and we do not guarantee the availability, quality, or outcome of any pumping service.

3. User Accounts

To use the App, you must create an account. You agree to:

• Provide accurate and complete information when registering
• Keep your account credentials secure and confidential
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activity that occurs under your account

You must be at least 18 years old to create an account and use the App.

4. Service Requests

When you submit a service request through the App, you acknowledge and agree to the following:

• Site Access: The job site is open, accessible, and the concrete pump truck will have clear access to the pour location.
• Hazard-Free Environment: The site is free from hazards including overhead power lines, recently excavated or unstable soil, and other dangerous conditions that could affect safe pump operation.
• Washout Area: A designated area is available for washing out the pump truck after the pour is complete, away from storm drains and environmentally sensitive areas.
• Water Supply: An adequate water supply is available on site for priming the pump and washout procedures.
• Scheduling: Requested dates are subject to availability. The pumping company will contact you to confirm scheduling.
• Cancellation: Cancellations must be made at least 24 hours in advance to avoid cancellation fees, unless otherwise agreed with the pumping company.
• Payment: Payment terms will be discussed upon confirmation of your service request. Payment is made directly between you and the pumping company.
• Concrete Supply: You are responsible for coordinating with your concrete supplier for timely delivery. Pump standby charges may apply for delays.
• Liability: You assume responsibility for ensuring proper site conditions and any damage resulting from failure to meet the requirements stated above.

5. Business User Terms

If you use the App as a pumping company staff member, you additionally agree to:

• Provide accurate information about your fleet, equipment, and service capabilities
• Respond to service requests in a timely and professional manner
• Ensure that your organization's profile and contact information are kept up to date
• Use customer information only for the purpose of fulfilling service requests
• Comply with all applicable laws and regulations related to your pumping operations

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws
• Submit false, misleading, or fraudulent service requests or account information
• Attempt to gain unauthorized access to other users' accounts or our systems
• Interfere with or disrupt the operation of the App or its infrastructure
• Reproduce, distribute, or create derivative works from the App without our permission
• Use the App to harvest or collect personal information of other users

7. Intellectual Property

The App, including its design, features, content, and code, is owned by Concrete Pumping Services CPS, LLC and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for its intended purpose. This license does not grant you any rights to our trademarks, logos, or branding.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure.

We do not guarantee the availability of any pumping company or truck, the accuracy of scheduling, or the quality of any services provided by pumping companies through the App.

9. Limitation of Liability

To the maximum extent permitted by law, Concrete Pumping Services CPS, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the App, including but not limited to:

• Loss of profits, revenue, or business opportunities
• Property damage at job sites
• Delays or failures in concrete pumping services
• Inaccurate information provided by other users or pumping companies
• Service interruptions, data loss, or unauthorized access to your account

10. Indemnification

You agree to indemnify and hold harmless Concrete Pumping Services CPS, LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your account at any time, with or without cause, and with or without notice. You may stop using the App at any time. Upon termination, your right to use the App ceases immediately. To request account deletion and removal of your personal data, contact us at support@bookapump.com.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the App or on our website. Your continued use of the App after any changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Mississippi, without regard to its conflict of law provisions. Any disputes arising from these Terms or the use of the App shall be resolved in the courts of the State of Mississippi.
